The CBI has moved the Calcutta High Court seeking the death penalty for Sanjay Roy, convicted in the RG Kar hospital rape-murder case. The West Bengal government has filed a similar appeal.

Sanjay Roy was sentenced to life imprisonment in the RG Kar rape and murder case. A lawyer, appearing on behalf of the Central Bureau of Investigation (CBI), has sought capital punishment for convict Sanjay Roy.

Judge Anirban Das said crime did not fall under “rarest of the rare” category as justification for not giving death penalty to Sanjay Roy.

The trail court had sought death penalty for Sanjay Roy but was turned down by the trail court, where Additional District and Sessions Judge Anirban Das said that the crime did not fall under the ‘rarest of the rare’ category.

Sanjay Roy was held guilty under Sections 66 (rape), 64 (causing injury resulting in death) and 103 (1) (murder) of the Bharatiya Nyaya Sanhita.
